Terms and Conditions of the Hawkly Dominik Koterski Online Store

§1 General Provisions

  1. These Terms and Conditions define the rules for using the online store operated by “Hawkly Dominik Koterski,” based in Poland, NIP: 5932645442, REGON: 529975433.
  2. The online store available at https://hawkly.eu is operated by Hawkly Dominik Koterski and offers SEO services and digital products such as e-books and ranking backlinks. We have many years of experience in SEO and online marketing. Although the Hawkly company has been operating since October 2024, we previously provided services as a team of freelancers.

  4. The company’s headquarters is located in Poland, in the town of Tczew (83-110), Pomeranian Voivodeship, at Władysława Jurgo 5a/8. All traditional correspondence should be sent to this address.
  5. These Terms and Conditions apply to both Consumers and Entrepreneurs using the store, except for provisions that clearly refer only to Consumers.
  6. Our services are intended for companies, entrepreneurs, bloggers, and owners of all types of websites, provided that their activity is legal under Polish law.

§2 Definitions

  1. Seller – the company “Hawkly Dominik Koterski,” which fulfills orders placed through the online store.
  2. Buyer – a natural person, legal person, or organizational unit making a purchase of products or services in the store.
  3. Digital product – an intangible product available in the store, including e-books, courses, ranking backlinks, and other SEO services.
  4. SEO service – activities related to website optimization and ranking, provided by the Seller to improve search visibility.
  5. Order – the Buyer’s declaration of intent leading to the conclusion of a sales contract, specifying the digital products or services, their quantity, and the method of payment.

§3 Scope of Services and Offered Products

  1. The store offers SEO products and services, including:
    • Ranking backlinks intended to improve the Buyer’s website visibility.
    • SEO services, including optimization and SEO audits.
    • E-books and educational materials related to SEO.
  2. All materials and services offered in the store are intended for private and professional use, in accordance with their purpose and applicable laws.
  3. The Buyer agrees to use purchased products according to their purpose and in compliance with these Terms.
  4. We only promote websites and content that comply with Polish law. If we find that the client’s website violates or may violate legal regulations, we reserve the right to refuse the service. If payment has already been made, a refund will be considered individually, taking into account costs incurred before refusal. When purchasing backlinks for more than one domain, the Seller may — without prior consultation — replace a domain with another one that meets the Terms.
  5. The content provided as part of our services may be generated using AI-based tools. However, every text is manually reviewed, edited, and adapted by our team before publication or delivery to the client to ensure compliance with client guidelines.

§4 Placing Orders and Contract Execution

  1. The Buyer may place orders through the store’s website. Orders are processed only after full payment has been credited to the Seller’s bank account.
  2. By placing an order, the Buyer declares that they have read and accepted these Terms.
  3. When purchasing services or digital products such as backlinks or e-books, the Buyer agrees to immediate performance and acknowledges that, once service execution begins, they lose the right to withdraw from the contract (pursuant to Article 38 item 13 of the Consumer Rights Act).
  4. The execution of SEO services may require additional communication with the Buyer to determine order details (e.g., keyword selection or website information).
  5. The Seller issues a VAT-exempt invoice after payment has been credited. The invoice will be issued to the details provided by the Buyer when placing the order.
  6. We do not sign separate contracts with clients. Purchasing a service via our store constitutes acceptance of the Terms and serves as the basis for executing the order. A report is delivered according to the delivery time specified for the service.
  7. Service execution takes up to 30 business days, depending on other orders and their queue. The standard waiting time is approximately 10 days.
  8. The execution time may be extended at the client’s request. If the standard delivery time is 30 business days, but the client chooses more frequent publication (e.g., every 3 days), the total execution time will extend accordingly.
  9. The execution time may be extended by up to 10 additional business days for non-standard orders. A “standard order” is one that does not exceed the number of linked domains or anchors allowed in the selected offer.
  10. Digital products are non-refundable. For backlinks placed on public platforms such as forums, profiles, or blogs that we do not own, we cannot guarantee their longevity. Sponsored articles published on our own websites remain available permanently. If the content of an article does not meet the client’s expectations, we offer free revisions until full satisfaction.
  11. Some services may have additional individual terms or specific rules listed in the description of the particular offer. If inconsistencies arise between these Terms and a specific service’s rules, the latter supersede the general Terms.
  12. By purchasing a service and accepting the Terms during checkout, the Buyer authorizes the Seller to share the service execution report and the Buyer’s domain address with third parties interested in the Seller’s offer — for demonstration and showcase purposes. This may include sharing the report as an example or case study, without disclosing personal data. The Seller will ensure confidentiality and compliance with applicable data protection regulations.

§5 Prices and Payment Methods

  1. All prices for products and services in the store are expressed in Polish złoty (PLN) and include applicable taxes.
  2. The Buyer may choose from the available payment methods, including electronic payments and bank transfers.
  3. The Seller reserves the right to change prices; however, price changes do not affect orders placed before the modification date.

§6 Delivery of Digital Products

  1. Digital products are available for download immediately after payment is credited or will be sent to the provided email address.
  2. For SEO services, the Seller will inform the Buyer about the service start date and estimated completion time.
  3. The Buyer must provide a correct email address and all information required to complete the order.

§7 Right of Withdrawal

  1. For digital products or SEO services, the Buyer acknowledges that under Article 38 item 13 of the Consumer Rights Act, the right to withdraw does not apply once the service begins or digital content not supplied on a physical medium has been delivered.
  2. Before placing an order for digital products or SEO services, the Buyer consents to immediate execution and accepts that they lose the right to withdraw once execution begins.
  3. For physical products (if offered), the Buyer has 14 days from receipt to withdraw from the contract.

§8 Complaints and Warranty

  1. The Seller ensures that digital products and SEO services are consistent with their description and free from technical defects.
  2. If a defect is found in a purchased digital product or SEO service, the Buyer may submit a complaint within 14 days of discovering the defect.
  3. Complaints should be submitted via email to the Seller’s contact address, including the defect description and order details.
  4. The Seller will review the complaint within 14 business days. If accepted, the Buyer will receive a defect-free product or another agreed solution.

§9 Personal Data Protection

  1. The Seller processes Buyers’ personal data in accordance with Polish law and the Privacy Policy available on the store’s website.
  2. Providing personal data is voluntary but necessary to place an order and complete it. Data will not be shared with third parties except as required by law.
  3. The Buyer has the right to access, correct, and request deletion of their personal data.

§10 Liability

  1. The Seller is not responsible for the Buyer not achieving expected SEO results, as SEO outcomes depend on numerous external factors, including search engine algorithms, policy changes, and competitor actions.
  2. The Seller commits to making every effort to ensure the best possible SEO results but does not guarantee results within a specific timeframe.
  3. The Buyer must follow the Seller’s SEO recommendations; any changes made to their website without consultation may affect the effectiveness of the service.

§11 Abuse and Exploitation of System Errors

  1. The store reserves the right to verify orders for abuse, including attempts to exploit system errors or obvious pricing mistakes.
  2. Abuse includes, among others:
    – purchasing products or services at a price grossly different from the market value (e.g., less than 10% of the actual price)
    – deliberately exploiting technical errors, payment system flaws, distorted information, or system malfunctions
    – attempting to bypass store rules to obtain unjustified benefits

3. If such actions are detected, the Seller reserves the right to:
– cancel the order without obligation to fulfill it
– refuse to issue a full refund
– fulfill the order only to the extent corresponding to the amount actually paid
– block the user’s account or refuse future orders

4. These actions are justified under the Civil Code, including:
– Article 84 §1 – regarding declarations of intent made under error
– Article 86 §1 – regarding fraud
– Article 58 §1 – regarding invalidity of legal acts contrary to the law or intended to circumvent it

§12 Final Provisions

  1. The Seller reserves the right to amend the Terms and Conditions. Changes become effective upon publication on the store’s website.
  2. By placing an order, the Buyer accepts the Terms and Conditions in the version applicable at the time of purchase.
  3. In matters not covered by these Terms, the provisions of the Polish Civil Code and other applicable laws shall apply.
  4. All disputes arising from the use of the store shall be resolved by the competent common court under applicable Polish law.
